Hourly Computer Professionals

In order to qualify for overtime exemption, a California computer software employee who is paid hourly, must earn no less than $36.00 per hour for every hour worked ($49.77 per hour in 2007) and meet other specific job duties requirements set forth by California Law under California Labor Code 515.5 (California Computer Professional Exemption).

Given the high level of independent judgment and discretion and highly specialized knowledge this exemption requires, only a small subset of computer professionals will actually qualify for the exemption.
