Discrimination / Wrongful Termination

Federal and state anti-employment discrimination laws prohibit discrimination in the work place based on an employee's race, color, religion, age, gender, or disability. We represent individuals in a range of employment-related issues, including sexual and racial harassment, age discrimination, overtime pay issues, pregnancy discrimination, and breaches of employment contracts.

An employee cannot be fired, however, for illegal reasons and he/she cannot be fired in a way that violates personal rights to be free from personal injury. Therefore, an employee who wishes to sue for wrongful termination must show either:

• That his employment contract, either expressly or implicitly, included a promise that he would not be fired without cause; or
• That his employer fired him for a reason that violates a fundamental policy expressed in California's statutes or constitution, including laws against unlawful discrimination; or
• That the employer committed an unlawful act such as defamation, invasion of privacy, or intentional infliction of emotional distress.
